Due high amounts of the questions concerning import to the Russia or EAEU (EAC – old name Custom Union) radio product or encrypted products we decided to make this road map, to help better understand importing rules and regulatory documentation for radio or encrypted devices!

Let’s start with FSB abbreviation or FSB notification

FSB stands for Russian Security Burea (transcription name ) in English it will be Federal Security services which in short way will sounds like FSS Notification

So FSS notification is English version of FSB transcription name

Same Belongs to Russian FCA certification ( Federal Communication Agency ) or Russian FAC certification ( Federal agency of Communication)

For What product you need to get FSB notification? list of a product for FSB notification

Below is the list of products which belong to encryption (cryptographic) means or include encryption (cryptographic) means, technical and cryptographic characteristics of which are subject to notification:

1. Products, which include encryption (cryptographic) means, which have any of the following components:

Symmetric cryptographic algorithm, which uses the cryptographic key, the length of which does not exceed 56 bits; or asymmetric cryptographic algorithm, based on any of the following methods:

a) Factorization into prime numbers, the size of which does not exceed 512 bits;

b) Calculation of discrete logarithms, in the multiplicative group of the finite field, the size of which does not exceed 512 bits; or

c) Discrete logarithm in the group, the size of which is different from that named in the above item “b”, and does not exceed 112 bits.

Note: Parity bits are not included in the key length.

2. Products, which include encryption (cryptographic) means, and have limited functions:

а) Authentication, which includes all aspects of access control, where there is no file or text encryption, except for encryption, which is directly

related to protection of passwords, personal identification numbers or similar data for protection from unauthorized access;

b) Digital signature. Note: Functions of authentication and digital signature include the function of keys distribution which is related to them.

3. Components of software operation systems, cryptographic possibilities of which cannot be changed by users, which are developed for installation by users without further substantial support by supplier and which have technical documents available (description of cryptographic transformation algorithms, interaction protocols, description of interfaces, etc.)

4. Personal smart-cards (intelligent cards):

а) Cryptographic capabilities of them are limited to usage on equipment or in systems, which are specified in items 5 – 8 of this list; or

b) For wide public usage, cryptographic capabilities of which are not available to users and due to a special design they have limited capabilities of protection of personal information, which is stored on the card. Note: If an intelligent card can perform several functions, then the reference status of each function shall be specified individually.

5. Receiving equipment for radio broadcasting, commercial TV or similar commercial equipment for broadcasting on a limited territory without encryption of a digital channel, except for cases when encryption is used solely for control of video or audio channels and sending of reports or return of the information, which is related to the program, to broadcast providers.

6. Equipment, cryptographic capabilities of which are not available to users, which is custom developed and limited for use by any of the following:

а) The software is made in the copy protected form;

c) Copy check of video and audio information, which is copyright protected.

7. Encryption (cryptographic) equipment, which is specifically developed and limited for use to banking and financial transactions. Note: Financial transactions include fees and payments for transportation services and credit financing.

8. Portative or mobile radio electronic devices of civil purpose (for example, for use in commercial civil systems of cellular radio communication), which are not capable of end-to-end encryption (i.e. subscriber-to-subscriber) So called Poin-to Point

9. Wireless radio electronic equipment, which encrypts information only in the radio channel with the maximum wireless range without amplification and bridging less than 400 m in accordance with technical specifications of manufacturer.

10. Encryption (cryptographic) means used for protection of technological channels in information and telecommunication systems and communication networks.

11. Products, the cryptographic function of which is blocked by manufacturer

he Eurasian Economic Commission (EEC), as the regulating body of the Customs Union, defines the list of products that are subject to non-tariff barriers. The EEC decree No134, dated August 16, 2012, creates the grounds for obtaining the notification. Chapter 2.19 of the decree reflects the full list of products that are subject to notification

Submitting FSB Notification

Bellow I the steps for FSB submission

Step 1: Fill in the Notification Form, following instructions provided on the FSB website: http://clsz.fsb.ru/docs/fn.htm

Step 3: After filling the notification, it should be passed to the FSB’s Center for Licensing, Certification and State Secrets Protection.

Applying for Ministry of Industry and Trade License

Step 1: Check HS code of the product. If it is in chapter 2.19 (http://clsz.fsb.ru/files/download/reshenie_N_134.doc), proceed to Step 2. Step 2: Review information at http://www.non-tariff.gov.ru/

Step 3: Fill in the application via the above website. If the online form does not work, you can mail the application to the address: 109074,

Step 4: Attach to the application: copy of a valid purchase/sales contract and related documents, verified by the signature and official company stamp of the applicant. Label all attachments: “This copy is verified”

Step 5: Attach copy of the firm’s certificate of registration with a tax authority, verified by the signature and stamp of the applicant.

Step 7: If you sell high frequency equipment, make sure to determine if you need to obtain a statement from the State Radio Frequency Center: http://www.grfc.ru/grfc/English/index.htm and Roskomnadzor permit

Roskomnadzor Temporarily Import

High frequency equipment and law frequency equipment will require in county test which will be performed at State Radio Frequency Center: http://www.grfc.ru/grfc/English/index.htm

To legally import the products for in country test company will require Roskomnadzor Temporarily Import

Product which will pass the RFC in country test ( which will comply with Russian HF or LF approved to use frequency list ) will be placed into Roskomnadzor data base and will be fee ready for import by any company

FSB Notification

FSB Notification is a notification on importation into the EEU Customs Union of goods that are cryptographic means or include cryptographic means technical or cryptographic specifications whereof are subject to notification with approving authorities of the Customs Union member states.

In each country (entering the Eurasian Economic Union) appointed its authorized body for registration notifications.

Issuing notification

Which documents regulate importation of cryptographic equipment into Russia?

Decision of the Board of the Eurasian Economic Commission No. 30 of April 21, 2015, in particular, section 2.19 of Annex No. 2 and the Regulation on import of encryption (cryptographic) means to the customs territory of the Eurasian Economic Union and their export from the customs territory of the Eurasian Economic Union (Annex No. 9 to the Decision).

Who can be an applicant for a notification?

According to clause 3 of the Regulation on notification manufacturer of the product or their authorized representative may be an applicant for a notification.

If the notification is not submitted by the manufacturer, the applicant will need a legalized power of to represent manufacturer’s interests in the competent state authority.

Can an individual submit a notification?

An individual may apply for a notification provided that they have a legalized power of attorney from the manufacturer to represent them in the FSS.

Can I consolidate several items into a single notification?

Yes, you can, if the following conditions are met:

Which expiration date can I specify?

Article 6 indicates the expiration date of the notification in the format dd.mm.yyyy. The only requirement to this date is that the manufacturer must keep the cryptographic characteristics of the item (model) unchanged before the expiration date. There are no other restrictions on the minimum or maximum period of validity of the notification in the law.

A product contains an encryption-capable module (Bluetooth/Wi-Fi) that can be shipped both within the product and separately. Can I submit a notification for the module only?

If the module will be delivered separately and declared at customs as a separate item, then a separate notification will have to be submitted.

As an option you can submit a single-item notification (i.e. notification for the product with one or many different encryption modules) and indicate after the name of the product «and spare parts».

Power of attorney

What should the power of attorney from the manufacturer look like?

The power of attorney should be drawn up in English or in any other official language of the producer’s country. The following information should be specified in the text of the PoA:

A power of attorney should be notarized and legalized in the manufacturer’s country.

A notarially certified translation of the PoA into Russian must be made before submitting it to the Russian Federal Security Service.

What are the key points of the notarization of the PoA?

The notary should certify two facts:

What is legalization and what kinds of legalization exist?

The legalization procedure allows a document issued in one country to be used for legal purposes in another country.

All documents signed by a representative of a foreign company must be legalized before submitting to the Federal Security Service or other State authorities of Russia.

There are 2 options for legalizing a document: apostille and consular legalization.

Apostille is an international standardized form for the legality of a document to be presented on the territory of countries that acknowledge this form of legalization.

Consular legalization is a multi-staged procedure of confirming the legality of the document issued by government bodies of a country in another country. This way of legalization is similar to the apostille, but is used for documents from the states that are not parties to the Hague Convention.

China specific: can certification by China Council for the Promotion of International Trade be used instead of notarization?

Previously (until 2016) the FSS accepted the Chinese power of attorney certified in the China Council for the Promotion of International Trade. However, in 2016 the FSS changed its attitude towards this type of document processing and insisted on a notarial certification of the PoAs from China with their subsequent consular legalization.

Is it necessary to make a notarial translation in Russia if the power of attorney and notarial certification were translated in the producer’s country?

Such a document would have to be translated in any case. Even if a notary in the country of the producer translates the PoA or issues it in Russian language, the Apostille will still be drawn in the official language of the country.

If some parts of the power of attorney (such as the Apostille stamp) are not translated, the FSS does not consider this as a full PoA translation.

Registration

How are the documents submitted to the FSS?

The originals of the documents should be sent to the Center for Licensing, Certification, and Protection of State Secrets of the FSS[1] by mail or directly to: Moscow, Yartsevskaya str., bld. 30 by the authorized representative of the company.

How long does it take to obtain registered notification?

The FSS registers the notificaion (or refuses to do that) within 7 working days.

After that, within 10 days, the information about the registered notification is included in the Common register.

Where can I find a list of registered notifications?

A list of registered notifications, both valid and expired/abolished, is available at the Eurasian Economic Commission website: Common register.

How is the notification presented to Customs?

Notification registration number is specified in the field 44 on the customs declaration.

According to the Regulation the notification is valid from the date of its inclusion into the Common register. Thus, according to law, customs should confirm the release of goods after the notification appears in the Common register.

Can the notification registered in Kazakhstan or Belarus be used for the import/export of goods to/from Russia?

Yes, it can. A notification registered in any of the five member countries of the Eurasian Economic Union (Armenia, Belarus, Kazakhstan, Kyrgyzstan, Russia) and listed in the Common register of notifications, is in force throughout the entire EAEU territory.

Is it possible to find out who submitted particular notification?

The applicant of the notification is not mentioned in the Common register. In other words, this information is almost impossible to find out unless you get a copy of the notification.

Miscellaneous

How do customs know whether the imported product is an encryption mean or not?

The Customs inspector is guided by the note to section 2.19, which reads as follows: «For the purposes of this section, both the EAEU HS code and the name of the goods should be used». Thus, the inspector must make sure that both conditions are met. Not meeting any of them means that there is no need to obtain notification or provide information from the Common register in the Customs declaration.

In practice, however, if product’s HS code is in the section 2.19, the customs inspector usually requests a notification or a confirmation that the item does not actually contain any cryptography.

What can be done if my product has no encryption functions, but its HS code is in the list from section 2.19?

1. The importer may provide the Customs authorities with official technical documentation for the good, that clearly states that the good does not have any cryptographic functions.

If such documentation is available only in a foreign language, a notarial translation should be made.

2. The importer may submit an official letter from the manufacturer of the product confirming that the product does not have cryptographic functions.

If the manufacturer is a foreign company, such letter may need legalization and notarial translation too.

3. The importer may obtain a conclusion on the absence of encryption. This conclusion is issued by an organization which has a certificate for testing cryptographic devices.

In this case, the customs may also require documents (certificate) confirming the competence and authority of the organization issuing the conclusion.

Уведомления ФСС: новый вид документооборота в ViPNet ЭДО Отчет

ТЕОРИЯ

С 2020 года ФСС внедряет систему социального электронного документооборота (СЭДО) для взаимодействия между медицинскими организациями, ФСС РФ, работодателями и другими организациями посредством юридически значимых электронных документов. С помощью СЭДО ФСС сможет передать страхователю юридически значимую информацию и получить подтверждение, например проинформировать работодателей о выданном, закрытом или оплаченном листке нетрудоспособности.

Целью внедрения СЭДО является упрощение процедур оформления страховых событий между работником, работодателем, медицинской организацией и ФСС. Также Фонд рассчитывает существенно ускорить процессы оформления ЭЛН и реестров прямых выплат, сократив количество ошибок работодателей в оформлении документов в электронном виде.

На примере оформления листка нетрудоспособности можно увидеть, как выглядело взаимодействие до внедрения СЭДО:

Помимо повсеместного внедрения механизма прямых выплат, Фонд изменил и схему передачи данных о статусах ЭЛН и самом страховом событии, а также дополнительных уведомлений по результатам проверки реестров выплаты пособий, полученных от работодателей.

Новый процесс СЭДО предполагает следующие шаги:

Эти процедуры исключают необходимость вовлечения работника в документооборот по сути между медицинской организацией, работодателем и ФСС.

В данный момент в продуктивном контуре СЭДО ФСС при содействии разработчиков учётных и кадровых систем, а также операторов ЭДО, работодателям доступно получение двух типов уведомлений: уведомления об изменении статуса ЭЛН (включая создание ЭЛН на стороне медицинской организации) и уведомления по результатам обработки реестров и заявлений на выплату пособий (ПВСО).

Для обмена и получения уведомлений реализована подписная модель, в рамках которой работодатель должен выполнить ряд шагов:

Подписаться и получать уведомления от ФСС можно в бухгалтерских программах, а также в системах документооборота операторов ЭДО. Большинству абонентов электронной отчётности уже доступна возможность получения уведомлений.

ПРАКТИКА

В ViPNet ЭДО Отчет реализован механизм подписки, а также отдельный раздел с уведомлениями от ФСС. Функционал доступен всем абонентам, достаточно обладать аккаунтом в системе и подключённым направлением сдачи отчетности в ФСС.

Предварительная настройка

Для подписки на уведомления от ФСС необходимо перейти в карточку основной компании.

В карточке компании на вкладке «Направления сдачи отчётности» необходимо нажать кнопку «Подписаться на уведомления», которая находится под направлением ФСС.

В появившемся окне создания подписки необходимо указать сотрудников, на события которых выполняется подписка, выбрав их из справочника с помощью кнопки «Добавить».

При выборе сотрудников можно указать одного, нескольких (нажимая клавишу Shift на клавиатуре и выбирая их мышью) либо всех сотрудников (клавиши Ctrl+A).

После выбора сотрудников необходимо нажать кнопку «Подписаться», после чего окно закроется и сообщение о подписке будет направлено в ФСС через транспортный сервис оператора ЭДО.

Подписку на уведомления должен подтвердить ФСС.

Отслеживать статус подписки или обнаруживать возникающие ошибки можно в карточке компании на вкладке «Направления сдачи отчётности» рядом с направлением сдачи отчётности в ФСС. Также можно повторно подписаться на уведомления при наличии ответа об ошибке подписки от Фонда.

На этом действия по оформлению подписки на уведомления СЭДО ФСС закончены.

Получение и обработка уведомлений

После выполнения подписки уведомления от ФСС будут приходить автоматически и отображаться в специальном разделе в программе. Ниже приведён пример вида интерфейса с выбранной опцией «Показывать документы по направлениям».

Новое уведомление выделяется в списке полужирным начертанием. При переходе к уведомлению можно увидеть извещение в формате ФСС, а также кнопки обработки уведомления и его историю.

Для обработки необходимо выбрать уведомление и нажать соответствующую кнопку в правой части окна.

Для ПВСО доступны кнопки, позволяющие прямо в системе подтвердить получение уведомления и перейти к искомому реестру для работы с ним.

Для событий по ЭЛН доступны кнопки, позволяющие прямо в системе подтвердить получение уведомления, а также отписаться от уведомления по данному работнику или загрузить ЭЛН из ФСС, чтобы оформить его или использовать в реестре ПВСО без запроса данных у работника.
