Таможенные органы в постановлениях по делам об АП часто делают вывод о том, что отметка в коносаменте freight collect, свидетельствует о наличии у грузополучателя обязанности оплатить перевозку. В действительности данная отметка свидетельствует лишь о моменте возникновения обязанности оплаты перевозки, а не о лице обязанном оплату провести.
Постановлением ФАС Дальневосточного округа от 12 апреля 2012 г. по делу №Ф03-1091/2012 дана оценка понятию freight collect.
Согласно постановлению, отметка в выставленных продавцом коносаментах “freight collect” в соответствии с пунктом 9.3 «Международные правила толкования торговых терминов «Инкотермс 2000» означает, что на продавца возлагаются расходы по договору перевозки независимо от того, уплачивается ли фрахт после отгрузки или по прибытии в пункт назначения (freight collect).
